The Gay/Straight Alliance Constitution
Article I: Name Section 1: The official name of the organization is The Gay/Straight Alliance of Fairmont State; a student organization for gay, lesbian, bi-sexual, transgender, queer, and their supporters. Section 2: GSA is understood in all cases to be synonymous with The Gay/Straight Alliance of Fairmont State. The GSA was formally known as BiGLS, the bi, gay, lesbian student organization.
Article II: Purpose Section 1: The purpose of GSA is to foster communication with, support, and strengthen the community of lesbian, gay, bi-sexual, transgender, queer, and their supporters at Fairmont State and the community. Section 2: Said purpose will be accomplished by creating a safe, committed, secure, and supportive environment for the lesbian, gay, bi-sexual, transgender, and their supporters by increasing social awareness and ensuring parity treatment in services, hiring processes, and grievance procedures for GSA students, faculty, and staff; through acts of public service; by discussing political issues relevant to the lesbian, gay, bi-sexual, transgender, queer community; and by providing outlets for social interaction among GSA members, supporters, and the community.
Article III: Membership Section 1: Membership in GSA is open to anyone who expresses goodwill towards the lesbian, gay, bi-sexual, transgender, and queer community. Section 2: The Gay/Straight Alliance of Fairmont State does not discriminate on the basis of race, color, sex, ethnic or national origin, age, gender identity, gender expression, HIV status, relationship/marital status, language proficiency, veteran status, religious affiliation, spiritual beliefs, political affiliation, enrollment status, class/ socio-economic status, ability, sexual orientation, ancestry, pregnancy, and/or citizenship status.
Article IV: Dues and Payment Section 1: No dues shall be required of any GSA member at any time.
Article V: Executive Cabinet Section 1: The Advisory Board is consisted of current Fairmont State faculty and/or staff. Section 2: The Executive Cabinet is the governing body of The GSA and consists of four (4) officer positions: President, Vice President, Secretary/treasurer, Sergeant at Arms. Section 3: All cabinet members are expected to give oral and written reports when needed to the cabinet, advisors, and members of GSA or Fairmont State. There should be an electronic copy of the report sent to the secretary. The cabinet members are expected to facilitate general meetings, coordinate with other officers and advisors; be a full-time student at Fairmont State during term of office; maintain at least a 2.0 GPA; may only have two (2) unexcused absences from meetings. Section 4: The President sets the agenda for each meeting, acts as a spokesperson for the organization for all levels of media, completes all necessary paperwork required by the office of student activities and Fairmont State; plans at least one (1) fundraiser each semester. The President may assign other officers or members to fulfill the duties listed above. Section 5: The Vice President acts as a liaison for the organization to the administration, faculty, and staff of Fairmont State; communicates with other lesbian, gay, bi-sexual, queer, and ally/supporter organizations; other student organizations; local, state, and federal officials. The Vice President will advertise general meetings and maintain the listserv; promote membership; and plan social events. Section 6: The Sergeant at Arms promotes the organizations membership diversity with particular respect to sexual orientation, gender identity, gender expression, and student enrollment status. The Sergeant at Arms is responsible for checking the organizations mailbox and attending the advisory council meetings; develop new educational programs and resources such as hand-outs, brochures, and banners; delegate responsibilities to assistants and work with them to manage the activities fairs; work to increase the number of educational resources available on lesbian, gay, bi-sexual, and transgender studies through the library. Section 7: The Secretary/Treasurer promotes communication between the executive cabinet and Advisors through regular updates in electronic mail and hard copy; maintains the financial records including deposits, expenditures, and other account activities; updates the Executive Cabinet and advisors on the financial status of the organization at each officers meeting; reserve room space and equipment for the organization meetings when needed; file all electronic and hard copy records of the organization; maintain minutes for all board and organization meetings; organize reports from the other officers after each officers meeting; act as membership coordinator and maintain the membership list; ensure the security and confidentiality of the membership list; verify membership at elections; and create ballots for elections and constitutional amendments. Section 8: Officers will serve terms of one calendar year, starting on the last day of Fall semester final exams week. A cabinet member cannot serve more than two (2) consecutive terms in the same office position.
Article VI: Quorum Section 1: The required quorum for all elections and constitutional amendments will be one-third (1/3) or thirty-three (33) percent of voting members as verified by the Secretary at the time of the vote. The requirements to be considered a voting member are as follows: must be a student at Fairmont State, Attended at least 8 meetings or events during the calendar year.
Article VII: Elections Section 1: Nominations will be accepted for new officers starting at the regular meeting four (4) weeks before the elections. Nominations may be opened on the day of the election upon a majority vote of the executive cabinet. Only members with a current voting status may accept a nomination, nominations must be seconded. Section 2: Elections for the new Executive Cabinet will be held at the regular meeting four (4) weeks before the final regular meeting of fall semester. The secretary shall verify voting status before a member is permitted to vote; any member with current voting status as defined in Article VI Section 1 will be eligible to vote. Votes shall be by secret ballot. Candidates must receive one (1) vote more than fifty (50) percent of votes cast to be declared cabinet-elect. The advisory board and a non-candidate designated shall independently count ballots, and the advisory board will announce the results. Section 3: In the event no candidate receives more than fifty (50) percent of ballots cast, there will be a run-off election immediately between the twp candidates who received the most ballots. In the event of a tie vote in a two-way election, the candidates will be allowed to speak on their own behalf, and a second vote will be taken, Section 4: Cabinet-elect will undergo a four-week mentoring process by the existing Executive Cabinet; Cabinet-elect will be required to attend all GSA related functions attended by their counterparts on the existing Executive Cabinet unless otherwise excused. Existing cabinet members will turn over all GSA related files to the new Executive Cabinet before the final regular meeting of Fall semester.
Article VIII: Vacancies in the Executive Cabinet Section 1: A GSA officer may resign by submitting in writing their intent to resign to the Executive Cabinet and Advisory Board two weeks prior to the intended resignation date. All resignations will be announced to members at the next meeting. Section 2: All Executive Cabinet vacancies will require a special election to be held within one month of the notification of the vacancy. Special elections will follow normal election procedures as enumerated in Article VII, Sections 2 and 3.
Article IX: Impeachment/ Removal of Officers Section 1: The reasons for impeachment of a GSA officer may include any or all of the following: Two (2) or more unexcused absences at GSA meetings and events, extreme misconduct as a GSA officer, dereliction of the duties entailed in Article V, Sections 2-8. Section 2: Any voting member can call for the impeachment of an officer at any general meeting. It must be seconded by a voting member and approved by a fifty (50) percent plus one (1) vote of present voting members. It must then be ratified by two-thirds (2/3) of the remaining officers.
Article X: Meetings Section 1: All meetings will be held at a specific time and place as decided by the executive cabinet and announced to GSA members Section 2: at all general meetings, it is the right of any GSA member to call for a vote of present voting members with a second from another member.
Article XI: Subgroups Section 1: Subgroups will be composed of GSA members to address specific tasks or issues. Each subgroup will have a chair appointed by the executive cabinet and must honor the GSA and Fairmont State constitutions. Subgroups will be dissolved upon completion of their assigned task or by the executive cabinet
Article XII: Amendments Section 1: The constitution may be amended by a two-thirds (2/3) vote of GSA members present at a regular scheduled meeting. Section 2: An amendment will be submitted in writing to the executive cabinet and must be approved by a simple majority then reviewed by the advisory board. It will then be discussed at the next regular meeting and voted on no later than three meetings after submitted.
Article XIII: Ratification of the Constitution Section 1: This constitution will be considered ratified by a majority vote at any general meeting.
