The Constitution of the Council

of Classified Employees of Fairmont State

 

Article I.  Name and Purpose 

Section 1.  The name of this organization shall be the Council of Classified Employees of Fairmont State College, hereinafter referred to as the Council. 

Section 2.  The purpose of this Council shall be:

 

To serve as an additional means of communication between the classified staff of the college, the administration, and the institutional Board of Governors. 

To formulate and revise as needed a classified staff handbook containing all pertinent policies, rules, and regulations. 

To provide a channel whereby classified staff may express needs and concerns. 

To learn changes in employee benefits (i.e., retirement, insurance, etc.) in order to disseminate such information among classified staff. 

To serve as a representative body for the classified staff of the college. 

To participate in such policy matters of the college as may directly affect the classified staff. 

To foster a spirit of cooperation among all employees of the college.

 

Article II.  Membership 

Section 1.  There shall be ten members of this Council representing the following job categories at Fairmont State College: 

Secretarial/Clerical

Administrative/Managerial

Physical Plant/Maintenance

Professional/Non-faculty

Paraprofessional

 

In addition, the FSC representative to the State Advisory Council of Classified Employees shall be a voting member.  

The terms of office shall be two years and elections will be held during the month of April of each odd-numbered year at a general meeting of all classified staff in each job category.  The term shall begin in July of each year. Each category will elect two representatives and an alternate. 

To be elected to the Council one must be a full-time, regular employee.  If a vacancy occurs, the alternate will continue the term of office.  If the alternate should vacate the position, an election will be held.  Members of the job categories listed above may present ideas and requests through their representatives to the Council.

 

Section 2.  The Director of Human Resources shall serve in an advisory capacity as an ex-officio member of the Council and shall have no voting privilege. 

Article III.  Officers 

Section 1.  The classified staff shall elect a Chair.  The Chair of the Council shall preside at meetings of the council   

Section 2.  The Council shall elect a Vice-Chair.  If the Chair cannot attend a meeting, the Vice-Chair shall preside at the meeting.  The Vice-Chair shall present the staff report at each Board of Governors meeting.  If the Vice-Chair is unable to attend a Board meeting, he/she shall name a Council member to present the staff report. 

Section 3.  The Chair shall name the Secretary who is a representative of the Secretarial/Clerical sector of the classified staff.  If the named Secretary is elected Chair then he/she will name a new Secretary. 

 

Section 4.  The Secretary of the Council shall record the proceedings of each meeting of the Council.  The minutes will be submitted to the Council members for approval.  When finalized, the minutes will be posted to the Council website and will be submitted to the office of the Assistant to the President. 

Section 5.  The minimum qualification for the Chair is that he/she shall have served one year as a member of the Council prior to his/her election. 

Section 6.  The Council Chair shall be elected in the month of April. 

Section 7.  The Chair and/or Vice-Chair shall determine the agenda for the regular meeting.  Council members shall submit agenda items to the Chair or Vice-Chair for this purpose.

 

Article IV.  State Advisory Council of Classified Employees (ACCE) Representative.  

Section 1.  As per 18B-6-4a in the WV State Code, during the month of April of each odd-numbered year, each state institution of higher education shall elect one classified employee to serve on the state advisory council.  This Council delegates the responsibility of coordinating the election to the Office of Human Resources. 

Section 2.  The elected representative shall abide by the regulations as set forth in 18B-6-4a in the WV State Code. 



Article V
.  Meetings 

Section 1.  Regular meetings of the Council shall be held on the third Thursday of each month at 2:30 p.m. in room 309ED. 

Section 2.  Special meetings may be called by the Chair of the Council or by any other member.  When a special meeting is called, its purpose will be given when the meeting is called.

 

Article VI.  Amendments 

Amendments to this constitution may be made by an affirmative vote of at least six members of the Council.  A notice that an amendment is to be proposed must be given to all members of the Council at least 10 days before the meeting at which the amendment is to be proposed.  The notice shall contain the proposed amendment in context or the general nature of the mater.
